This Privacy Policy applies to personal information collected when:

• You visit our website, www.promptu.com (the "Site");
• You download and/or use the ViewFinder mobile software application (the "App");
• Any services are provided by us to you in connection with your use of the App; and
• You directly communicate with us.

When we refer to the "Services" throughout this Privacy Policy, we mean, collectively, the Site, the App (including any related services provided by us to you in connection with your use of the App), and any other websites, products, software, applications, content, data feeds and other services on which an authorized link to this Privacy Policy is posted.

IF YOU DO NOT AGREE TO THE PRIVACY PRACTICES DESCRIBED IN THIS PRIVACY POLICY, PLEASE DO NOT ACCESS OR USE ANY OF THE SERVICES. IF YOU ARE UNDER THE AGE OF 16, PLEASE DO NOT ACCESS OR USE ANY OF THE SERVICES OR PROVIDE PROMPTU ANY PERSONAL INFORMATION.

Promptu reserves the right to revise this Privacy Policy at any time for any reason. If we make revisions to this Privacy Policy, we will post the revised Privacy Policy prominently on the Site at www.promptu.com/privacy.html, with the "last updated" date revised accordingly. If we make material changes with respect to the personal information collected by the App and/or related services, we may also send a notification through the user interface of the App that the Privacy Policy has been updated. Where express consent is required by applicable law for the lawful collection, use, or disclosure of information about you, we will obtain that consent. We encourage you to review this Privacy Policy regularly for any changes. Your continued use of the Services (or any part thereof) and/or your continued provision of personal data to us after the posting of the revised Privacy Policy will be subject to the terms of the then-current Privacy Policy.

Personal data, or personal information, means any information about an individual from which that person may be identified. For example, it may include your name, telephone number, email address, or payment information, and in some jurisdictions your IP address. It does not include data from which the identity of an individual has been definitively removed along with any identifiers connected to such individual (also known as anonymous or anonymized data).

Registration Imformation

If you choose to sign-up to register a user account (an “Account”), and when you sign-in to the Services with your Account, we will collect:

• Your email address; and
• Your password and/or other login credentials

We use this information to register your Account and we save your watch list and other information to your Account to enable you to access your watch lists and other information when you log-in to your Account from other devices.

Usage Information Collected from the App

The App enables users to search for video content by voice or text command. When you use the App, Promptu collects certain usage information ("Usage Information"), including, but not limited to, your voice and text searches, in order to provide the App and related services to you and to continue to improve our technology and your customer experience.

Usage Information may also include your IP address; your device manufacturer, model and OS version; and other information that is needed for Promptu to deliver, monitor performance or improve the App and Services, or our technology in general. When you download the App to your device we assign a unique random number (the "Application Instance Number") to that instance, so that we are able to understand how you use the App. The Usage Information, including your searches, is tied to the Application Instance Number, and is considered "pseudonymized data". We do not make any attempt to link the Application Instance Number to any personally identifiable information, such as your name or device serial number.

Our product and customer service teams use this Usage Information to continually improve our technology.

Cookies and Related Technologies

A cookie is a small text file that is stored on a user's computer for record-keeping purposes. When you visit or access the Services, we may by means of cookies, beacons, tags, scripts, and/or similar technologies automatically collect technical information about the devices and software you use to access the Services, such as the type of Internet browser or mobile device you use, the website or source that linked or referred you to the Services, your IP address or device ID (or other persistent identifier that uniquely identifies your computer or mobile device on the Internet), the operating system of your computer or mobile device, and other similar technical information.

We use both session ID cookies and persistent cookies. Promptu may track users use of the Services, but does not track users across third party websites.

Except as explained above regarding the pseudonymized Usage Information, typically, all technical, analytics, and usage information is gathered by Promptu in anonymous form and does not identify you personally.

These same technologies (or a combination of them) may also be used to help us:

• Compile statistics and analytics about your use of and interaction with the Services, including details about how and where our Services are accessed, how often you visit or use the Services, the date and time of your visits, your actions on the Services, and information regarding in-App activities, and other similar traffic, usage, and trend data. These analytic tools allow us to better understand the functionality of our mobile software on your device and gain insights about how mobile software is used in order to improve your experience;
• Gather important functionality, testing, and performance data about our Services, including performance data related to the App, such as networking activity, CPU load, and resource usage, among other relevant data;
• Moderate user behavior on the Services, such as protecting against fraud and other inappropriate activities;
• Gather demographic information about our user base; and
• Perform other similar functions.

We may partner with third-parties to assist us in the collection and processing of information and data provided in connection with the use of the Services. For example, we make use of the Facebook SDK and various Google Firebase tools, including but not limited to Google Analytics for Firebase and Crashlytics. Other Information

Additionally, we may collect information from you if you communicate directly with Promptu, for example, in connection with human relations, accounting or customer service purposes.

Information Collected through Third Party Integrated Services

When you interact with third party products, applications and/or services that we have linked to or integrated in the App (collectively, “Third Party Services”) (for example, third party streaming services such as, Netflix, Hulu, and/or HBO, or when you share information with other people through the "share" functionality of the App, or when you sign into the App with your Apple ID to enable content sharing between devices), certain information and data may be collected by the applicable providers of the Third Party Services.

For example, if you sign-on with your Apple ID, Apple, Inc. collects your login in credentials, which is used to enable you to manage your watch lists and other saved information in the App across your compatible iOS devices.

The applicable providers of Third Party Services, and not Promptu, are in control of the data and information they collect in connection with your use and/or interaction with the Third Party Services through the App. The applicable providers of the Third Party Services may use your personal information differently than we do. Please review the privacy notices for the Third Party Services you use and/or interact with in connection with the App.

Targeting & Advertising

Promptu, through its third party service providers, use certain targeting and/or advertising cookies and similar functionality on the Site and when a user interacts with our online advertisement and/or downloads the App from the applicable app store. They are usually placed by advertising networks with the website operator’s permission or integrated in the functionality of the mobile app. They remember that you have visited a website and this information is shared with other organizations such as advertisers. In addition, they know whether a person has downloaded a mobile application after interacting with a specific online advertisement. Targeting or advertising cookies will often be linked to site functionality provided by the other organizations or can be linked to a specific advertisement. Promptu and its third party service providers listed below use this targeting/advertising to:

• Advertise the Services across the internet;
• Track and manage our advertising campaigns; and
• Track and manage downloads and installs of the App.

Promptu is currently using the following third party services:

Promptu uses your personal information to provide you with the Services as described in this Privacy Policy. We use such information to continually improve our Services, technology, products, systems and customer experiences. Additionally, Promptu may also collect information collected as described above and such other non-personal data as statistics about machines running our Services, so as to further understand and enhance the user experience, direct marketing, security, enforcement, and system integrity (prevention of hacks, unauthorized use, etc.).

Internal Operations and Affiliates

Promptu is a global company with headquarters in the United States and operations in both the U.S.A. and Australia. Personal information that we collect about you through the Services may be shared with the relevant global employees, contractors, and agents of Promptu and our affiliated and subsidiary entities ("Affiliates") who are involved in providing or improving the Services that we offer to you. We obligate the employees, contractors and agents of Promptu and our Affiliates to ensure the security and confidentiality of your personal information and to act on that personal information only in a manner consistent with this Privacy Policy.

Third Party Business Partners and Service Providers

Promptu may share your personal information with third party business partners, agents, contractors and/or service providers ("Service Providers") who assist us in enabling delivery of our Services to you. Below is an illustrative list of functions for which we may use Service Providers and the names of the Service Providers we may use to perform these functions:

• Analytics services (e.g., Google, Inc.);
• Customer support services;
• Hosting and content delivery network services (e.g., Amazon Web Services); and
• Professional service providers, such as auditors, lawyers, consultants, accountants and insurers.

Promptu takes steps to ensure that all Service Providers with access to personal information are capable of protecting the information we share with them.

Third Party Services

When you interact with Third Party Services in connection with or through the Services, certain data and information may be exchanged between us and the provider of the applicable Third Party Service. Third Party Services are not our Service Providers (as defined above), and the applicable providers of Third Party Services, and not Promptu, are in control of the data and information they collect in connection with your use and/or interaction with the Third Party Services through the App. The applicable providers of the Third Party Services may use your personal information differently than we do. Please review the privacy notices for the Third Party Services you use and/or interact with in connection with App.

Business Transfers

If Promptu enters into a merger, acquisition or sale of all or a portion of its assets or business, your personal information may be one of the transferred assets. Should such a sale or transfer occur, Promptu will require the buyer to treat your personal information in a manner that is consistent with this Privacy Policy.

Legal Disclosures

Promptu may disclose your personal information that we have received through your usage of the Services without your consent when we believe in good faith that the disclosure is required to comply with applicable law or respond to lawful requests or legal processes (such as a subpoena, warrant, court order, etc.) for the purpose of assisting law enforcement and legal authorities in the prevention, detection or prosecution of crime.

Anonymized Information

We share aggregated, automatically-collected or otherwise non-personal information with third parties for various purposes, including (i) compliance with reporting obligations; (ii) for business or marketing purposes; (iii) to assist us and other parties in understanding our users' interests, habits and usage patterns for certain programs, content, services, advertisements, promotions and/or functionality available through the Services. We do not share personal information about you in this case.

On or through the Services, we may provide third-party "share" buttons through text message, or for Facebook, Messenger, or other social media sites, which may function as web beacons when you interact with the button. If you share information with another person through the "share" functionality of the App (for example, you share your "Watchlist" with a friend or family member via text message, Facebook, messenger or other sharing option available through the App), the information (which may include information that identifies you) will be shared with the other person.

In addition, please note that you may send to the third party operator of such "share" button the information that you are viewing through the Services when you "share". If you are not logged into your account with the third party operator, then the third party operator may not know your identity. If you are logged in to your account with the third party operator, then the third party may be able to link information or actions about your interactions with the Services to your account with them. Please refer to each third party’s privacy policies to learn more about its data practices.

Promptu limits the amount of personal information that we collect from you when we provide you with the Services. Therefore, we provide notification about your privacy choices at various locations to ensure that you are well-aware of your privacy choices and options including in our apps, in the app store and on our websites.

Account Information

If you would like to correct or update your Account log-in email, or if you would like to delete your Account, please contact us at privacymatters@promptu.com and we will use reasonable efforts to correct and/or update such information and/or delete your Account.

Cookies and Similar Technologies

With respect to your choices regarding cookies and other similar technologies, most web and mobile device browsers automatically accept cookies, but if you prefer, you can change your browser to prevent that or to notify you each time a cookie is set. You can also learn more about cookies by visiting www.allaboutcookies.org which includes additional useful information on cookies and how to block cookies using different types of browsers or mobile devices.

Please note, however, that by blocking or deleting cookies used on the Services, you may not be able to take full advantage of the Services.

Promptu does not process or respond to web browsers' "do not track" signals or other similar transmissions that indicate a request to disable online tracking of users who use our Services.

If you have not otherwise opted out, or if you have opted in to receive direct marketing emails from us, we may use your personal information to send you marketing information about the Services. For instance, when you request additional information regarding the Services or sign up for our newsletter, we may ask if you wish to opt in to receive marketing communications from us for the Services. This is what we call direct marketing. We carry out direct marketing by email. We obtain consent to send you such communications where required under applicable local laws.

You may manage your receipt of marketing and non-transactional communications by clicking on the "unsubscribe" link located on the bottom of any of our marketing e-mails. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our databases. You cannot opt out of receiving transactional e-mails related to the Services (e.g., requests for support).

If you use the App, we may also deliver notifications to your mobile device (e.g., push notifications) on which you have installed the App. You can disable these notifications by deleting the relevant service or by changing the settings on your mobile device.

At Promptu, we are committed to protecting the security of your personal information. We have implemented industry standard practices with respect to physical, organizational and technology measures that are reasonably designed to protect your personal information against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification. Although we cannot guarantee that loss, misuse, or alteration of your personal information will not occur, we strive to prevent such occurrences and have business continuity and incident response plans in place to address loss or destruction of personal information.

We retain personal information for as long as needed or permitted in light of the purposes for which it was obtained and consistent with applicable law. In order to determine the most appropriate retention periods for your personal information, we consider the amount, nature and sensitivity of your information, the reasons for which we collect and process your personal data, and applicable legal requirements. In some instances, we may choose to anonymize your personal data instead of deleting it, for statistical use, for instance. When we choose to anonymize, we make sure that there is no way that the personal data can be linked back to you or any specific user.

Promptu does not require you to provide any sensitive data about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic, and biometric data to use the Services.

Use of the Services are not intended for individuals under the age of 16. Without limiting the foregoing, Promptu does not target the Services to persons under the age of 16 and does not knowingly collect personal data from minors. Therefore, we ask you not to provide us with personal information of persons under the age of 16. If we learn that personal information of persons under 16 years of age has been collected on or through the Services, then we may deactivate the account or otherwise terminate access to the Services and/or make the content inaccessible.

Your app store (e.g., Apple App Store or Google Play) may collect certain information in connection with your use of the App, including, without limitation, personal data, geolocational information, and other usage-based data. We have no control over the collection of such information by a third-party app store, and any such collection or use will be subject to that third party's applicable privacy policies.

On or through the Services, we may provide, for informational purposes only, links to other websites or resources with which we do not have a contractual relationship and over which we do not have control ("External Websites"). In addition, other users may post links to External Websites in connection with the use of the Services. Such links are not paid advertisements, nor do they constitute an endorsement by Promptu of those External Websites, and are provided to you only as a convenience. By clicking on links to External Websites, the operators of the External Websites may collect your personal information. We are not responsible for the content or data collection practices of those External Websites, and your use of External Websites is subject to their respective terms of use and privacy policies.

Promptu addresses complaints or disputes regarding personal information promptly and courteously. We will cooperate with country data protection authorities if they have reason to believe that a problem has occurred regarding the protection of personal information. In order to provide you with the Services, Promptu requires your personal information to be sent to our servers in the United States and Australia. Additionally, through our partnerships with Google (for analytics tools) and Amazon Web Service (for cloud hosting), your information may be transferred to other locations around the world. This means that your personal information may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction, and by accessing and/or using the Services you hereby irrevocably and unconditionally consent to such transfer, processing, and use in the United States, Australia and elsewhere.
